1. Data protection at a glance
General information
The following information provides a simple overview of what happens to your personal data when you visit this website. Personal data is any data that can be used to identify you personally. Detailed information on data protection can be found in this privacy policy.
Data collection on this website
Who is responsible for data collection on this website?
Data processing on this website is carried out by the website operator. Their contact details can be found in the section “Information about the controller” in this privacy policy and in the imprint.
How do we collect your data?
Some of your data is collected when you provide it to us, e.g. by entering it in a contact form. Other data is collected automatically by our IT systems when you visit the website. This is mainly technical data (e.g. web browser, operating system or time of the page request).
What do we use your data for?
Part of the data is collected to ensure that the website is provided without errors. Other data may be used to analyse your user behaviour, provided you have given your consent.
What rights do you have regarding your data?
You have the right at any time to receive information free of charge about the origin, recipients and purpose of your stored personal data and to request its rectification or erasure. You may withdraw any consent you have given at any time with effect for the future. Under certain circumstances, you may also request the restriction of processing. You also have the right to lodge a complaint with the competent supervisory authority. You can contact us at any time regarding these and other data protection questions.
2. Hosting
External hosting
This website is hosted by an external service provider (hoster). The personal data collected on this website is stored on the hoster’s servers. This may include, in particular, IP addresses, contact requests, meta and communication data, contract data, contact details, names, website access data and other data generated via a website.
The hoster is used for the purpose of fulfilling contracts with our potential and existing customers (Art. 6(1)(b) GDPR) and in the interest of a secure, fast and efficient provision of our online services by a professional provider (Art. 6(1)(f) GDPR). Our hoster only processes your data to the extent necessary to fulfil its service obligations and follows our instructions with regard to this data.
Our hoster is:
GoDaddy Deutschland GmbH
Friesenplatz 4
50672 Cologne, Germany
Data processing agreement
We have concluded a data processing agreement (Art. 28 GDPR) with the hoster. This ensures that the hoster processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.
3. General information and mandatory information
Data protection
The operators of this website take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.
Please note that data transmission over the internet (e.g. when communicating by email) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.
Information about the controller
The controller responsible for data processing on this website is:
A.G.W. Rental Deutschland GmbH
Im Ochsenstall 9
76689 Karlsdorf-Neuthard, Germany
Represented by the Managing Director: Andreas Schuraw
Phone: +49 7251 321 928 44
Email: info@agwrental.com
The controller is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data.
Storage period
Unless a more specific storage period is stated in this privacy policy, your personal data will remain with us until the purpose of the processing no longer applies. If you assert a justified request for erasure or withdraw your consent, your data will be deleted unless we have other legally permissible reasons for storing it (e.g. retention periods under tax or commercial law); in this case, deletion takes place once these reasons no longer apply.
Withdrawal of your consent to data processing
Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. The lawfulness of the processing carried out until the withdrawal remains unaffected.
Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)
If data processing is based on Art. 6(1)(e) or (f) GDPR, you have the right to object to the processing of your personal data at any time on grounds relating to your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your personal data concerned unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims (objection pursuant to Art. 21(1) GDPR).
If your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling insofar as it is related to such direct marketing. If you object, your personal data will subsequently no longer be used for direct marketing purposes (objection pursuant to Art. 21(2) GDPR).
Right to lodge a complaint with the competent supervisory authority
In the event of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged infringement. The supervisory authority responsible for us is:
The State Commissioner for Data Protection and Freedom of Information Baden-Württemberg
(Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg)
Lautenschlagerstraße 20, 70173 Stuttgart, Germany
www.baden-wuerttemberg.datenschutz.de
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible.
Information, rectification and erasure
Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, if applicable, a right to rectification or erasure of this data.
Right to restriction of processing
You have the right to request the restriction of the processing of your personal data, in particular if:
- you dispute the accuracy of your data stored by us – for the duration of the verification;
- the processing is unlawful, but you request restriction instead of erasure;
- we no longer need your data, but you need it for the establishment, exercise or defence of legal claims;
- you have lodged an objection pursuant to Art. 21(1) GDPR – as long as it has not yet been determined whose interests prevail.
If processing has been restricted, this data – apart from its storage – may only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another person or for reasons of important public interest of the EU or a Member State.
SSL/TLS encryption
For security reasons and to protect the transmission of confidential content, such as enquiries you send to us, this site uses SSL/TLS encryption. You can recognise an encrypted connection by the fact that the browser’s address bar begins with “https://” and by the lock symbol in your browser bar.
4. Data collection on this website
Cookies
Our website uses so-called cookies. Cookies are small text files that are stored on your device. Apart from the cookies for Google Ads described in section 6, we do not use any cookies. All other cookies are only set with your consent (Art. 6(1)(a) GDPR and Section 25(1) TDDDG), which you can withdraw at any time via the cookie settings. If further cookies are used, they are described separately in this privacy policy.
Cookie banner and storage of your choice
When you first visit our website, a cookie banner is displayed. There you can consent to the “Marketing” category or allow only the necessary functions. We store your choice in your browser’s local storage (key “agw-consent”). No cookie is set and nothing is sent to our server. Your choice is valid for 90 days; after that you will be asked again.
Storing your choice is necessary under Section 25(2) No. 2 TDDDG to apply your decision. Consent to marketing cookies is based on Art. 6(1)(a) GDPR and Section 25(1) TDDDG. You can change your decision at any time by clicking the cookie symbol at the bottom left of our website.
Server log files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- browser type and browser version
- operating system used
- referrer URL
- host name of the accessing computer
- time of the server request
- IP address
This data is not merged with other data sources. The data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – for this purpose, the server log files must be recorded.
Contact form
If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. We do not pass on this data without your consent.
This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary to carry out pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective processing of the enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), if this has been requested.
The data you enter in the contact form will remain with us until you ask us to delete it, withdraw your consent to storage or the purpose for storing the data no longer applies (e.g. after your enquiry has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.
Enquiries by email or phone
If you contact us by email or phone, your enquiry, including all resulting personal data (name, enquiry), will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.
The legal bases and storage periods correspond to those described in the section “Contact form”.
Processing of data (customer and contract data)
We collect, process and use personal data only to the extent necessary for the establishment, content or modification of the legal relationship (inventory data). This is done on the basis of Art. 6(1)(b) GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures. We collect, process and use personal data about the use of this website (usage data) only to the extent necessary to enable the user to use the service or to bill for it.
The customer data collected will be deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.
Data transfer upon conclusion of a contract
We only transfer personal data to third parties if this is necessary in the context of contract processing, for example to the credit institution commissioned with payment processing. Any further transfer of data does not take place or only takes place if you have expressly consented to the transfer. Your data will not be passed on to third parties without your express consent, for example for advertising purposes. The legal basis for data processing is Art. 6(1)(b) GDPR.
5. Third-party content on the website
Our website may integrate content from other providers, such as map services. For technical reasons, this content is loaded by your browser from the servers of the respective provider. In particular, your IP address and information about your browser are transmitted. Please refer to the privacy policies of the respective providers. Fonts (web fonts) are loaded locally from our server; no connection to Google Fonts servers is established.
Google Maps
This site uses the map service Google Maps. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. To use the functions of Google Maps, it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer. If Google Maps is activated, Google may use Google Web Fonts for the uniform display of fonts; for this purpose, your browser loads the required fonts into its cache.
Google Maps is used in the interest of an appealing presentation of our online offers and to make the locations indicated by us on the website easy to find. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user’s device. Consent can be withdrawn at any time.
Google LLC is certified under the EU-US Data Privacy Framework (DPF); on the basis of the European Commission’s adequacy decision (Art. 45 GDPR), the transfer of data to the USA is permitted. In addition, Google bases the transfer on the European Commission’s standard contractual clauses: https://privacy.google.com/businesses/gdprcontrollerterms/ and https://privacy.google.com/businesses/gdprcontrollerterms/sccs/.
More information on the handling of user data can be found in Google’s privacy policy: https://policies.google.com/privacy?hl=en.
OpenStreetMap
We use the open-source map service “OpenStreetMap” (OSM) of the OpenStreetMap Foundation, St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom, to display geodata. OSM is used to display an interactive map on our website. When it is accessed, the pages of our website you have visited, the IP address of your device and any data you enter for route planning are transmitted to the OSM servers, among other things.
The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest lies in an appealing presentation of our online offer and making the locations we indicate easy to find. If consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG; consent can be withdrawn at any time. The transfer of data to the United Kingdom is based on the European Commission’s adequacy decision.
Further information can be found in OSM’s privacy policy: https://wiki.osmfoundation.org/wiki/Privacy_Policy.
6. Advertising and conversion tracking
Google Ads and Google Conversion Tracking
This website uses Google Ads. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.
As part of Google Ads, we use so-called conversion tracking. When you click on an ad placed by Google, a cookie is set for conversion tracking. This allows us and Google to recognise that you clicked on the ad and were subsequently redirected to our website. We record as conversions the submission of our enquiry form (call-up of the confirmation page) as well as clicks on our phone numbers and email addresses.
The information obtained using the conversion cookie is used to create conversion statistics. We learn the total number of users who clicked on our ads and then performed one of the actions mentioned. We do not receive any information that can be used to personally identify users. Google may link the collected data with other data, in particular if you are logged into your Google account.
Data processed and cookies
In particular, your IP address, device and browser information, pages visited, date and time of access, the ad click ID (GCLID) and the recorded conversion are processed. The following cookies are set:
- _gcl_au – stores an identifier to attribute conversions to a previous ad click (storage period: 90 days)
- _gcl_aw – stores the click ID (GCLID) of a Google ad (storage period: 90 days)
Legal basis and withdrawal
Google Ads and conversion tracking are used exclusively on the basis of your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. The Google script is only loaded after you have consented to the “Marketing” category in our cookie banner. We use Google Consent Mode, which transmits your consent decision to Google. You can withdraw your consent at any time with effect for the future by reopening the cookie settings via the corresponding icon on our website and deactivating the “Marketing” category. The lawfulness of the processing carried out until the withdrawal remains unaffected.
Data transfer to the USA
It cannot be ruled out that data will be transferred to Google LLC in the USA. Google LLC is certified under the EU-US Data Privacy Framework (DPF). The DPF is an agreement between the European Union and the USA on the basis of which the European Commission has determined an adequate level of data protection (adequacy decision pursuant to Art. 45 GDPR). In addition, Google bases the data transfer on the European Commission’s standard contractual clauses (Art. 46(2)(c) GDPR).
Storage period
The conversion cookies are automatically deleted after 90 days. You can also delete cookies in your browser yourself at any time.
Further information on Google Ads and Google Conversion Tracking can be found in Google’s privacy policy: https://policies.google.com/privacy and at https://policies.google.com/technologies/ads.
